Terms of Use (v2.0)

1. Who you are agreeing with

"Mishami", "we", "us" and "our" mean Mishami, Inc., a corporation incorporated under the laws of the State of Delaware, United States, with its registered office at 131 Continental Dr, Suite 305, Newark, DE 19713, United States.

"You" means the adult who creates an account and uses Mishami as a parent or legal guardian.

2. What Mishami is

Mishami is a tool for adults. You describe, in one line, something your child is going through. Mishami writes a short personalised story with your child as the main character, plus a guidance card for you with questions to talk about and concrete things to try. You read the story aloud. Your voice does the work. The screen is ours, not your child's.

Mishami supports everyday emotional conversations between a parent and a child, typically aged 3 to 8. It is a parent-led tool. You decide what to read, what to skip, and what to do.

3. What Mishami is not

Mishami is not therapy, counselling, or psychotherapy.

Mishami is not a medical device, and it does not diagnose, treat, cure, prevent, or alleviate any disease, disorder, or condition.

Mishami is not a substitute for advice from a doctor, psychologist, therapist, teacher, or any other qualified professional.

Mishami is not an emergency service and does not monitor for emergencies.

Read this part twice. The current web version of Mishami does not screen what you write for signs of crisis. It will not detect that a child is in danger, and it will not alert anyone. If you are worried about your child's safety, about self-harm, about abuse, or about any acute situation, contact your local emergency services or a qualified professional immediately. Do not rely on Mishami, and do not wait for it to notice anything.

4. Who may use Mishami

You may use Mishami only if:

• you are at least 18 years old,
• you are the parent or legal guardian of the child you write about, or you have that person's permission, and
• you can enter into a binding contract where you live.

Children may not use Mishami. Do not give the account to a child, and do not let a child type into it. The stories are written for you to read aloud.

5. The beta, and what it means

Mishami is currently a free closed beta. There is no charge, no subscription, and no payment of any kind. If we introduce paid plans in future, we will present the price and the terms clearly and ask for your agreement before charging anything.

Because it is a beta:

• The service is provided as it is. Things may break, change, or disappear.
• We may change or withdraw features without notice.
• The current web version of Mishami will be retired on 30 September 2026. On that date the service stops and all data in it is permanently deleted, as described in our Privacy Policy. If you want to keep a story, copy it out before then. We will email a reminder before the date to the address on your account.

6. Your account

Keep your login details to yourself. You are responsible for what happens under your account. If you think your account has been compromised, write to care@mishami.com and we will help you secure or close it.

You may close your account at any time by writing to care@mishami.com. We will delete the account and its contents.

7. Stories are written by AI, and you are the last check

Mishami uses artificial intelligence to generate stories and guidance cards. To do this, the text you write is sent to our AI provider, as described in the Privacy Policy.

Generated text can be wrong, odd, or a poor fit for your child. Read every story before you read it to your child. You know your child. The software does not. Nothing in a guidance card is an instruction you must follow. It describes what often helps children in a similar situation, and you decide whether it fits yours.

If you get a story or a card that seems inappropriate, inaccurate, or harmful, send it to care@mishami.com. We read every one of these.

8. What you may and may not do

You may use Mishami for your own family, personally and non-commercially. You may read the stories aloud, print them, and keep them.

You may not:

• use Mishami to create content that is unlawful, hateful, sexual, violent, or harmful to a child,
• enter another person's personal information without the right to do so,
• attempt to break, overload, reverse engineer, or gain unauthorised access to the service,
• scrape or copy the service to build a competing product,
• resell, sublicense, or present Mishami's output as a commercial product of your own.

We can suspend or close an account that breaks these rules.

9. Who owns what

We own Mishami: the software, the design, the methodology, the guidance library, and the brand.

You own what you write into it. You give us permission to use what you write only to run the service for you: to generate your stories, to store them for you, and to keep the service working. We do not use what you write to train AI models, and our AI provider does not either, as described in the Privacy Policy.

The stories and guidance cards generated for you are yours to use for your own family, personally and non-commercially, for as long as they exist.

10. No warranty

Mishami is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted or error-free, or that any story or card will suit your child or produce any particular outcome.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here removes rights you have under mandatory consumer protection law in the country where you live.

11. Limitation of liability

To the fullest extent permitted by law, Mishami, Inc. and its officers, employees, and advisors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the service.

To the fullest extent permitted by law, our total liability to you for any claim relating to the service is limited to one hundred United States dollars (USD 100), reflecting that the service is provided free of charge.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

12. Indemnity

You agree to indemnify Mishami, Inc. against claims, losses, and reasonable costs arising from your breach of these Terms or your misuse of the service, except to the extent caused by us.

13. Changes to these Terms

We may update these Terms. If a change is significant, we will post the new version with a new date at the top and, where we hold your email address, tell you. If you keep using Mishami after a change takes effect, you accept it.

14. Ending it

You can stop using Mishami and close your account at any time, by writing to care@mishami.com.

We can suspend or end your access if you break these Terms, or if we retire the service. The current web version is being retired on 30 September 2026, as set out in Section 5.

15. Governing law and disputes

These Terms and your use of the service are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the service is subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, United States, unless mandatory consumer protection law in your country of residence gives you the right to bring claims in your local courts.

16. General

If any part of these Terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the whole agreement between you and us about the service.
