Terms of Use

Please read these Terms of Use ("Terms") carefully before using Mishami.
By accessing or using the Mishami website or web app (together, the "Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
"Mishami", "we", "us", or "our" refers to NAVIN PL Sp. z o.o., a company incorporated under the laws of Poland with its registered office at ul. Kornela Makuszyńskiego 15, 31-752 Kraków, Poland.
"You" refers to the adult user who creates an account and uses Mishami as a parent or legal guardian.
1. What Mishami Is (and Is Not)
1.1. Mishami is a web-based tool that helps parents and caregivers create short, personalized, emotion-focused stories and guidance ("Stories" and "Parent Cards") based on situations they describe from their child's life.
1.2. Mishami is designed to support everyday emotional conversations between you and your child (typically ages 3–8). It is a parent-led tool: you read the Stories aloud and decide how to use the ideas and suggestions.
1.3. Mishami is not:
- medical or psychiatric treatment,
- a psychological or psychotherapy service,
- a crisis or emergency support service,
- a substitute for professional diagnosis, therapy, or medical advice.
If you are worried about your child's safety, self-harm, abuse, or any acute crisis, you must immediately contact local emergency services or a qualified professional. Do not rely on Mishami in emergency situations.
2. Who May Use Mishami
2.1. You must be at least 18 years old and have legal capacity to enter into a contract to use the Service.
2.2. The Service is intended for use by adults (parents, guardians, caregivers). Children do not create accounts and should not enter information directly into the Service.
2.3. By using the Service, you confirm that:
- you are at least 18 years old,
- you are using Mishami on behalf of a child only as their parent or legal guardian, and
- all information you provide is accurate to the best of your knowledge.
3. Your Account
3.1. To access certain features (including saving Stories and using paid plans), you must create an account with your email address and a password.
3.2. You are responsible for:
- keeping your login credentials confidential,
- restricting access to your devices,
- all activities that occur under your account.
3.3. If you believe your account has been compromised, you must notify us promptly at care@mishami.com so we can assist with securing or disabling the account.
3.4. We reserve the right to suspend or terminate accounts that:
- violate these Terms,
- are used fraudulently or abusively, or
- pose security, legal, or operational risks.
4. Information You Provide
4.1. To personalize Stories, you may provide information such as:
- your child's first name or nickname,
- age,
- gender,
- favorite characters or interests,
- a short description of an emotional situation (e.g., tantrums, fears, jealousy, school worries).
4.2. You agree not to provide:
- full legal names, home addresses, phone numbers, exact school names, or other direct identifiers of the child,
- sensitive information that is not necessary for personalization (for example, detailed medical records, precise location data).
4.3. You are solely responsible for the content you enter into Mishami and for how you choose to present it to your child.
4.4. You must not use Mishami to create or store content that is:
- illegal, abusive, hateful or discriminatory,
- sexual or sexually explicit involving children in any way,
- violent, exploitative, or otherwise harmful.
We may remove or restrict access to content that we reasonably believe violates these rules.
5. Content, Ownership, and Licenses
5.1. Our Content
All software, text, designs, Parent Cards, templates, graphics, and other materials provided as part of the Service (excluding your inputs) are owned by NAVIN PL Sp. z o.o. or its licensors and are protected by copyright and other intellectual property laws.
5.2. Your Inputs
"User Input" means the text you provide to the Service, including descriptions of situations, names, and preferences.
You retain any rights you have in your User Input. By submitting User Input, you grant NAVIN PL Sp. z o.o. a worldwide, non-exclusive, royalty-free license to use, store, process, and reproduce that User Input:
- to provide and improve the Service,
- to generate Stories and Parent Cards for you,
- to maintain security and integrity of the Service,
- in anonymized or aggregated form for analytics and product improvement.
We will not publicly display or share your identifiable User Input or Stories without your explicit consent.
5.3. Generated Content (Stories and Parent Cards)
The Service generates personalized Stories and Parent Cards based on your User Input and our internal content library.
Subject to your compliance with these Terms and payment of applicable fees, NAVIN PL Sp. z o.o. grants you a limited, non-exclusive, non-transferable, revocable license to:
- access and use the Stories and Parent Cards for your personal, non-commercial, family use,
- read them aloud to your child,
- save, print, or privately share them with close family members or caregivers.
You may not:
- resell, sublicense, or commercially exploit the Stories or Parent Cards,
- remove any proprietary notices,
- present Mishami's content as your own commercial product.
If, in the future, we invite you to share Stories publicly (for example, for a community library or marketing), we will ask for separate, explicit permission and explain the conditions.
6. Free Use and Paid Plans
6.1. Free Use
We may offer a free tier (for example, a limited number of personalized Stories) that does not require a payment method. Details of the current free tier are shown on our website or in the app.
6.2. Paid Plans
We offer paid options (such as story packs and subscriptions). The pricing, features, and billing periods are described on the Pricing page and/or within the Service.
By starting a paid plan, you authorize us and our payment provider (Stripe) to charge the applicable amounts, including any recurring subscription fees, to your chosen payment method.
6.3. Payments via Stripe
Payments are processed securely by Stripe. We do not store full card numbers, CVC codes, or other sensitive payment details. We store only limited payment metadata (such as plan type, payment status, and transaction IDs) necessary for billing and support.
6.4. Renewals and Cancellations
If you sign up for a subscription, it may automatically renew at the end of each billing period unless you cancel before renewal, as described in the Service.
You can cancel future renewals at any time via the Service (if available) or by contacting us at care@mishami.com. After cancellation, you will retain access to your plan until the end of the current paid period. We do not provide refunds for partial periods unless required by applicable law.
6.5. Introductory Pricing
From time to time, we may offer limited "intro" or launch pricing. Any such offers, their duration, and conditions will be described in the Service. After such period, standard pricing may apply, but active subscriptions may retain their existing rate as indicated at the time of purchase.
7. Health, Psychology and Crisis Disclaimer
7.1. Mishami supports emotional conversations and parenting, but:
- does not provide diagnosis or treatment,
- does not replace consultation with a doctor, psychologist, or therapist,
- does not guarantee changes in behavior or emotional outcomes.
7.2. You are solely responsible for deciding how to use the Stories and Parent Cards with your child. If you are concerned about your child's mental or physical health, you must seek professional advice.
7.3. Mishami is not suitable for emergencies.
If you or your child are in crisis, facing self-harm, abuse, or any situation involving risk of harm, you must immediately contact:
- local emergency services,
- your doctor or mental health professional, or
- local crisis hotlines or support services.
8. Disclaimer of Warranties
8.1. The Service is provided on an "as is" and "as available" basis.
8.2. We do not warrant that:
- the Service will be uninterrupted, error-free, or free from harmful components,
- any particular Story or Parent Card will be suitable for your specific situation,
- the Service will meet all of your expectations.
8.3. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Your use of the Service is at your own discretion and risk.
9. Limitation of Liability
9.1. To the maximum extent permitted by applicable law, NAVIN PL Sp. z o.o. and its directors, employees, and service providers shall not be liable for:
- any indirect, incidental, special, consequential, or punitive damages,
- loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.
9.2. To the extent we are found liable despite the above, our total aggregate liability in connection with the Service will be limited to the amount you paid to us for the Service during the six (6) months immediately prior to the event giving rise to the claim, or, if you have only used the free tier, to the equivalent of EUR 50.
9.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for intentional misconduct.
10. Your Responsibilities
10.1. You agree to:
- use the Service only in accordance with these Terms and applicable laws,
- not attempt to reverse engineer, decompile, or hack the Service,
- not use the Service for any unlawful, harmful, or exploitative purpose.
10.2. You are responsible for:
- how you present Mishami's content to your child,
- decisions you make in parenting based on or alongside the Service.
11. Termination and Suspension
11.1. You may stop using the Service at any time. You may request deletion of your account and associated personal data by contacting us at care@mishami.com, as described in our Privacy Policy.
11.2. We may suspend or terminate your access to the Service if:
- you violate these Terms or applicable law,
- we suspect fraud, abuse, or a security risk,
- we discontinue the Service for business or legal reasons.
11.3. Upon termination:
- your right to use the Service ceases,
- any licenses granted to you under these Terms will end,
- certain provisions that by their nature should survive (such as ownership, limitation of liability, and dispute resolution) will continue to apply.
12. Governing Law and Disputes
12.1. These Terms and your use of the Service are governed by the laws of Poland, without regard to conflict of law principles.
12.2. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Poland, unless mandatory consumer protection law in your country of residence gives you the right to bring claims in your local courts.
12.3. Nothing in this section limits any rights you may have as a consumer under mandatory laws of your country of habitual residence.
13. Changes to the Service and to These Terms
13.1. We may update or modify the Service over time, including adding or removing features.
13.2. We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top and, where required by law, notify you by e-mail or within the Service.
13.3. Continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, you must stop using the Service.

15. Assignment
15.1. We may assign or transfer our rights and obligations under these Terms, in whole or in part, to another company in connection with a reorganization, merger, acquisition, sale of assets, or similar business transaction relating to Mishami.
15.2. If such a transfer occurs, we will take reasonable steps to inform you (for example, via e-mail or within the Service) and ensure that the new entity continues to honour these Terms and our Privacy Policy, or provides updated terms that respect your rights under applicable law.
15.3. You may not assign or transfer your rights or obligations under these Terms to another person without our prior written consent.
